1.0   Disclaimer and Limitations of Liability

1.2 You acknowledge that you are entirely responsible for all activities or results arising from your access to the QuoteStation products and services, and in particular for any investment decisions you make. We cannot accept any responsibility for any consequences arising from your use of the QuoteStation products and services or reliance on data delivered via the QuoteStation products and services. Neither Europoint Systems d.o.o. nor Data Providers accept any liability to User or any third party for any loss or damage arising from any inaccuracy, delay, error or omission in the QuoteStation products and services or the data incorporated into the QuoteStation products and services. In no event will Europoint Systems d.o.o. or Data Providers be liable to you, your costumers or any third party for any direct, indirect, incidental, consequential, special or exemplary damages (including but not limited to lost profits, trading losses or damages that result from inconvenience, delay or loss of the use of QuoteStation website or QuoteStation products and services), or claims arising in tort (including negligence), even if Europoint Systems d.o.o. or Data Providers have been advised of or are otherwise aware of the possibility of any of the foregoing.

1.5 Information available through QuoteStation website and QuoteStation products and services may be obtained from professional business or organizations, such as stock exchanges, news providers, market data providers and other content providers, who are believed to be sources of reliable information. Nevertheless, due to various factors – including the inherent possibility of human and mechanical error – the accuracy, completeness, timeliness, results obtained from use, and correct sequencing of information available through QuoteStation website and QuoteStation products and services are not and cannot be guaranteed by Europoint Systems.

1.6 QuoteStation website and QuoteStation products and services may provide you with the ability to access a variety of information, material or other content from third parties. You understand and agree that such third parties are solely responsible for any such content, and you further agree that Europoint Systems is not, and will not be, liable for any content and other material posted or otherwise provided by third parties. You agree that Europoint Systems d.o.o. will not be liable for any trading activities or other activities that occur on any website you access through links on QuoteStation website.

1.7 You accept that you may be liable to Europoint Systems d.o.o. and to any Data Provider for any direct losses that we or they may incur as a result of your default or breach of this Agreement. Our liability to you for any direct loss or losses arising from our default or breach under the terms of this Agreement shall be limited to the amount of the Subscription Charges already paid in the last three months in which the loss arises.

1.8 You will not be liable to Europoint Systems d.o.o. and we will not be liable to you for any indirect losses, including loss of business or loss of profits, arising in any way from this Agreement or from breaches of this Agreement

1.9 You release Europoint Systems d.o.o., including its officers, directors, employees, or any other agents, from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with any dispute with any user of QuoteStation website and/or QuoteStation products and services, or arising in any way from content posted to QuoteStation website and/or QuoteStation products and services by any third party.

2.0   Force Majeure

In addition of applicable disclaimers, stated above, QuoteStation performance shall be excused in the event of interruption and/or delay due to causes beyond its reasonable control, such as acts of God, acts of nay government, war or other hostility, civil disorder, the elements, fire, earthquake, explosion, act of terrorism, power failures, equipment failure, industrial or labor dispute, acts of Data Providers or other third party information providers, third party software or communication method of interruption.

3.0   Sources

3.1 Original Stock Exchange Data – data which Stock exchanges deliver to Europoint Systems d.o.o., for further distribution to End Users.

3.2 Derived Data – data representing processed Original Stock Exchange Data

3.3 The Stock Exchange will be liable for the accuracy, authenticity and completeness of the Original Stock exchange Data according to the Agreement between Stock Exchange and Europoint Systems d.o.o.

3.4 The Original Stock Exchange Data are property of Stock Exchange and represent the intellectual property of Stock Exchange

3.5 Derived Data are created on the basis of Original Stock Exchange Data

3.6 Fundamental data used in Fundamental Analysis are collected from the Stock Exchange website or other sources and Europoint Systems d.o.o. is not, and will not be, liable for any direct, indirect, incidental, consequential, special or exemplary damages (including but not limited to lost profits, trading losses or damages that result from inconvenience, delay or loss of the use of QuoteStation website or QuoteStation products and services), deriving from use of Fundamental analysis data found on QuoteStation website and/or QuoteStation products and services.

3.7 Data obtained from Belgrade, Ljubljana, Sarajevo, Banja Luka, Macedonian and Montenegro Stock Exchange following data represent Original Stock Exchange data:

Symbol, ISIN number, Trading method, Full name of security, Name of issuer, Currency, Maturity date (optional), Nominal value (optional), Type of price, Type of security, Price, Best Bid Price, Best Bid Quantity, Best Ask Price, Best Ask Quantity, Sum Bid, Sum Ask, Volume, Open, High, Low, Trend, Change, Phase, Fluctuation Zone, Level 2, Bid Price, Bid Quantity, Ask Price, Ask Quantity, Transaction Price, Quantity, Time of Trading, Index Date, Index Value, Index Change

3.8 All other data related to securities listed on Belgrade, Ljubljana, Sarajevo, Banja Luka, Macedonian and Montenegro Stock exchange shall be considered Derived Data.

3.9 News found on QuoteStation website and/or QuotesStation products and services are news received from BETA, ONASA and MIA news agency, and retrieved from other sources such as Stock Exchange websites, Central Depositary Agency websites, Security Commission websites.
